Terms and Conditions

These Terms and Conditions (“Terms”) apply to all services provided by Locol 3D, the 3D services division of Locol Design Ltd, a company registered in the United Kingdom under company number 13512194, with its registered office at 4 Laureens Walk, Nevill Rd. Rottingdean, Brighton BN2 7HG, United Kingdom. By commissioning work or using our services, you (“Client”, “You”) agree to be bound by the following Terms, unless otherwise agreed in writing.

  1. Scope and Acceptance of Services

These Terms govern all engagements between Locol 3D and the Client, including but not limited to:

  • 3D Rendering
  • 3D Modelling
  • Product Visualisation
  • Animation
  • Product Design
  • Related Creative and Digital Services

Any instruction, whether verbal, written, or electronic, shall constitute acceptance of these Terms. Variations shall only be valid if confirmed in writing by Locol 3D.

  1. Pricing, Invoicing, and Payment Terms
  • Pricing will be based on a written quote provided by Locol 3D. In absence of a formal quote, standard hourly or daily rates apply.
  • All fees are payable in GBP (£) unless otherwise agreed.
  • Invoices are payable upon receipt unless specified otherwise.
  • Queries must be raised within 7 days of the invoice date.
  • Overdue payments will incur interest at 8% per month above the Bank of England base rate, calculated daily and compounded monthly.
  • Additional charges may apply if project delays or complications arise due to lack of client input, incomplete briefs, or revisions beyond agreed rounds.
  1. Deposits and Cancellations
  • A deposit or upfront payment may be required before work begins. This is non-refundable once work has commenced.
  • If the Client cancels a project after commencement, 50% of the agreed project fee (or the cost of work completed to date, if higher) will be payable.
  • Locol 3D reserves the right to cancel any project at its discretion. In such cases, the Client will only be liable for work completed to date.
  1. Delivery & Client Responsibilities
  • Delivery dates are estimates and not guaranteed.
  • The Client agrees to provide all necessary information, assets, and approvals in a timely manner to avoid delays.
  • Locol 3D is not liable for delays caused by the Client’s failure to provide such materials or feedback.
  1. Revisions and Additional Work
  • Projects include a set number of revisions as agreed in advance.
  • Any revisions or changes beyond the agreed scope will be billed at the following hourly rates:
    • Project Manager: £60/hr
    • 3D Designer: £50/hr
  • All changes must be communicated clearly in writing.
  1. Intellectual Property & Licensing
  • All designs, 3D models, animations, and related deliverables remain the property of Locol 3D until full payment is received.
  • Upon full payment, the Client receives a non-exclusive, non-transferable licence to use the deliverables for the intended project.
  • Locol 3D retains the right to showcase work (excluding confidential or embargoed material) for marketing, portfolio, and promotional purposes unless otherwise agreed in writing.
  1. Exclusions and Third-Party Costs

Unless otherwise stated, quotes do not include:

  • Licensing for stock assets (models, textures, music, etc.)
  • Costs for third-party services (e.g., voiceover artists, software licences, render farms)
  • Additional specialist services (e.g., prototyping, engineering analysis, surveys)

These may be arranged and charged separately with the Client’s consent.

  1. Liability and Warranties
  • Locol 3D will exercise reasonable care and skill in delivering services but makes no warranties as to fitness for a particular purpose unless expressly agreed.
  • Locol 3D is not liable for:
    • Loss of profits or revenue
    • Loss of data or business opportunity
    • Indirect, incidental, or consequential damages
  • The Client assumes full responsibility for using the deliverables in their own commercial context.
  1. Accuracy and Technical Data
  • Locol 3D makes no guarantees regarding measurement accuracy, tolerances, or engineering integrity unless such factors are specifically part of the project scope.
  • Any CAD files, models, or dimensional data should be verified independently before manufacturing or implementation.
  1. Subcontracting and Assignment
  • Locol 3D reserves the right to assign or subcontract parts of the project to trusted third-party collaborators.
  • The Client may not transfer or assign their rights under these Terms without prior written consent.
  1. Confidentiality
  • Both parties agree to maintain confidentiality of sensitive information shared during the project.
  • This obligation does not apply to public or previously known information or when disclosure is required by law.
  1. Termination
  • Either party may terminate the agreement with written notice if the other breaches these Terms and fails to remedy the breach within 14 days.
  • Upon termination, the Client remains responsible for payment for all work completed to that point, including any applicable cancellation fees.
  1. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  1. Entire Agreement

These Terms represent the entire agreement between the parties and supersede all previous discussions, communications, and agreements. No oral statement or representation shall be binding unless confirmed in writing.
